ACCEPTABLE USE POLICY (AUP) – BOTMAX AI

1. Introduction

This Acceptable Use Policy (“Policy”) governs the use of services provided by BotMax AI Technologies Private Limited (“BotMax AI”, “we”, “our”, “us”), including all associated platforms such as cloud.botmaxai.com, automation.botmaxai.com, biller.botmaxai.com, dialer.botmaxai.com, crm.botmaxai.com, mail.botmaxai.com, and botmaxai.com (collectively referred to as the “Services”).

This Policy is designed to ensure that the Services are used in a lawful, ethical, and responsible manner. By accessing or using BotMax AI, you agree to comply with this Policy in addition to our Privacy Policy and Terms & Conditions.

2. Purpose and Scope

BotMax AI provides tools for automation, communication, customer engagement, and integrations with third-party platforms such as WhatsApp Business API and related services. The platform is intended for legitimate business use cases including customer support, transactional messaging, notifications, and approved marketing communications.

This Policy applies to all users, including businesses, administrators, employees, agents, and any individual accessing the Services.

3. General User Responsibilities

Users are expected to use BotMax AI in a manner that complies with all applicable laws, regulations, and third-party platform policies. This includes ensuring that all communications sent through the platform are lawful, consent-based, and relevant to the intended recipients.

Users are responsible for maintaining the confidentiality of their account credentials and for all activities conducted under their account. Any misuse, unauthorized access, or suspicious activity should be reported promptly.

4. Permitted Use

The Services may be used for legitimate business purposes such as customer communication, service notifications, order updates, support interactions, and consent-based promotional messaging where permitted by applicable laws and platform policies.

Users may utilize automation tools, chatbot workflows, APIs, and integrations provided by BotMax AI strictly within the boundaries of lawful and ethical usage.

5. Prohibited Activities

To maintain platform integrity and compliance, certain activities are strictly prohibited.

Users must not use BotMax AI to send unsolicited or spam messages, including bulk communications without proper user consent. Any attempt to bypass consent mechanisms or manipulate user engagement is not permitted.

The platform must not be used for illegal, fraudulent, deceptive, or misleading activities. This includes phishing, impersonation, financial scams, or distribution of false or harmful information.

Users are prohibited from sending content that is abusive, defamatory, obscene, hateful, or discriminatory in nature. Any communication that promotes violence, harassment, or illegal activities is strictly forbidden.

BotMax AI must not be used to transmit malware, viruses, or any harmful code that could disrupt systems, compromise data, or damage infrastructure.

Users must not attempt to reverse engineer, hack, disrupt, or gain unauthorized access to the platform, its servers, or other users’ data. Any activity that interferes with system performance or security is considered a violation.

The platform must not be used in violation of third-party terms, including those of Meta Platforms, Inc., payment gateways, or any integrated services.

6. Messaging and Consent Requirements

Users are required to obtain clear and verifiable consent from recipients before sending messages through the platform, especially when using channels such as WhatsApp Business API.

All messaging must comply with applicable laws, including data protection and anti-spam regulations, as well as third-party policies. Users must ensure that recipients have the ability to opt out or unsubscribe from communications where applicable.

BotMax AI provides tools to facilitate messaging, but the responsibility for compliance with consent and communication regulations lies with the user.

7. Third-Party Platform Compliance

BotMax AI integrates with third-party services to provide core functionality. Users must adhere to the terms, policies, and guidelines of these platforms at all times.

Users acknowledge that actions such as account suspension, restriction, or termination by third-party providers may occur independently based on their policies. BotMax AI does not control such decisions but may assist users where reasonably possible.

8. Monitoring and Enforcement

To maintain platform security and compliance, BotMax AI may monitor usage patterns, system activity, and potential violations. Monitoring is conducted in accordance with applicable laws and our Privacy Policy.

If a violation of this Policy is identified, BotMax AI reserves the right to take appropriate action, which may include issuing warnings, restricting access, suspending accounts, or terminating services. In serious cases, we may report violations to relevant authorities.

9. Suspension and Termination

BotMax AI may suspend or terminate access to the Services if a user engages in activities that violate this Policy, applicable laws, or third-party terms.

Such actions may be taken without prior notice in cases where immediate action is necessary to protect platform integrity, users, or third-party systems.

Where feasible, users may be informed of violations and given an opportunity to address concerns before permanent action is taken.

10. User Accountability

Users are solely responsible for the content they create, upload, or distribute through BotMax AI, as well as the recipients they engage with. The platform provides tools and infrastructure but does not control or pre-approve communications.

Users are expected to maintain accurate records of consent where required and to demonstrate compliance if requested by regulators or third-party platforms.

12. Policy Updates

BotMax AI may update this Acceptable Use Policy from time to time to reflect changes in legal requirements, technology, or platform usage. Updated versions will be published on our website.

Continued use of the Services after updates constitutes acceptance of the revised Policy.

13. Relationship with Other Policies

This Acceptable Use Policy should be read in conjunction with our Privacy Policy and Terms & Conditions. In case of any conflict, the Terms & Conditions shall prevail.

14. Fair Use and Platform Integrity

BotMax AI is designed to deliver reliable and scalable communication infrastructure. Users are expected to use resources fairly and not engage in excessive or abusive usage patterns that may negatively impact system performance or other users.
